Definitions

SERVICE: playwithtamil.com operated by Agaminfotech Inc.

PERSONAL DATA: Information that identifies an individual (name, email, phone number, etc.).

USAGE DATA: Information about your site interaction (IP address, browsing history).

COOKIES: Small files stored on your device to enhance functionality.

USER: Anyone who accesses or uses the Service.

DATA CONTROLLER: Agaminfotech Inc., responsible for deciding data use.

DATA PROCESSORS: Third-party companies handling data on our behalf.

Features, Plans, and Limitations

Silver Plan

• Access to create and play up to 5 activities (across all grades); activities, once created, cannot be deleted.
• Enroll in one course; courses, once enrolled, cannot be deleted.
• Join or create up to 2 zones; zones, once created, cannot be deleted.
• No access for kid account creation.
• Cannot create assignments.

Gold Plan

• Unlimited activity and zone creation and deletion.
• Unlimited course enrolling and unenrolling options.
• Ability to create assignments.

Titanium Plan

• Designed for users who want accounts primarily for children.
• Create up to 5 kid accounts under one primary parent account; kid accounts have full platform access, excluding assignment creation.
• Primary account holder retains Silver Plan access unless upgraded to Gold Plan.
• Kid accounts have separate login credentials but are secondary accounts under the primary parent account.

Platinum Plan (Profit School Plan)

• Access to dedicated school management system, enabling management of school-related activities, courses, assignments, invitations for teachers, students, and volunteers.
• School-related data remains private and inaccessible externally.
• Creator/admin pays upfront for all invited Kids and Teachers. Volunteers receive free accounts.
• School admins retain unlimited individual-side Gold Plan access until subscribed or bounded to a school.
• Invited teachers and students gain temporary Gold (teachers) or Titanium (kids) Plan access while affiliated with the school. Post-affiliation, access reverts to viewing-only Silver (teachers) or Titanium (kids), requiring individual subscription to regain interactive capabilities.

Diamond Plan

• Similar to Platinum Plan, but subscription fees are directly carried by invited Teachers and Parents.
• Parents must subscribe to Titanium Plan for their children's accounts upon accepting invitations.
• Teachers must subscribe individually to the Gold Plan.
• Volunteer accounts remain free.
• School admins retain unlimited individual-side Gold Plan access until subscribed or bounded to a school.

Information Collection and Usage

We collect Personal, Usage, Location (with consent), and Cookies Data to:

• Operate, maintain, and enhance the Service.
• Notify users about service changes.
• Provide customer support.
• Ensure compliance with legal obligations.
• Detect and prevent fraud, technical issues, and unauthorized access.

Data Retention and Security

We retain data only as long as necessary to meet legal and business requirements. Upon account deletion request, data is stored securely for 21 days, after which it is permanently deleted. We use strong encryption and security protocols but cannot guarantee absolute security against unauthorized breaches.

Data Transfer and Disclosure

Data may be transferred internationally, ensuring equivalent protection measures. We may disclose your data:

• During business mergers or acquisitions.
• To comply with legal requirements or governmental requests.
• For fraud prevention and user safety.

User Obligations

• Users must provide accurate and truthful information.
• Users agree not to misuse the platform, engage in fraudulent activities, or attempt unauthorized access.
• Users must promptly notify us of any unauthorized use of their accounts or data breaches.

GDPR and CIPA Compliance

We adhere strictly to GDPR and CIPA, ensuring:

• Clear consent and transparency regarding data collection.
• Right to access, rectify, restrict, and delete personal data.
• Parental consent required for users under 16.
• Filtering and monitoring to block harmful content.
• Active notifications to parents regarding unsafe activities.

Volunteer Terms

• Volunteer Allocation: 20 volunteers allocated per 100 student-count milestones.
• Conversion upon Count Reduction: Admin notified to manually convert volunteers to teachers upon student-count reduction. Automatic conversion after repeated admin reminders.
• Conversion Terms:
  • Volunteer-to-Teacher: Requires subscription to Gold Plan; no free conversions.
  • Teacher-to-Volunteer: Free conversion executed only by admin.

Supported Devices and Browsers

• Devices: Android, iOS (iOS 16+), macOS (Big Sur+), Windows (Windows 11+).
• Browsers: Chrome, Edge. Ensure browsers are updated.

Intellectual Property & Copyright

All content, software, designs, illustrations, logos, trademarks, platform features, course structures, games, graphics, animations, and technology available on Playwithtamil are the intellectual property of Agaminfotech Inc. or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.

Users may not:

• Copy, reproduce, distribute, modify, sell, or republish Playwithtamil content without prior written permission.
• Reverse engineer or attempt to extract source code from any part of the platform.
• Remove copyright notices, branding, or proprietary markings.
• Use Playwithtamil content for commercial purposes without authorization.

Authors retain ownership of the original content they create and publish through Playwithtamil. By submitting content to the platform, the author grants Playwithtamil a worldwide, non-exclusive, royalty-free license to review, store, display, distribute, promote, and publish the submitted work through the Playwithtamil platform and related promotional channels.

Authors are solely responsible for ensuring that their submitted work does not violate any copyright, trademark, intellectual property rights, or applicable laws. Playwithtamil reserves the right to remove any content that is found to infringe upon the rights of others.

Author Publishing Policy

Playwithtamil provides a publishing platform for authors to share educational books and learning materials.

Book Submission

Before a book becomes publicly available, every submitted book undergoes an internal review process. Submission does not guarantee publication. Playwithtamil reserves the right to approve, reject, or request modifications to any submitted content at its sole discretion.

Publishing Fees

• The author's first published book is free of charge.
• Every additional book submitted after the first free publication requires payment of the applicable publishing fee.
• The publishing fee displayed during submission is the final amount payable.
• Authors must complete payment before the review process begins.
• Prices shown at the time of submission cannot be modified after payment.
• Payment of the publishing fee does not guarantee approval or publication.

Review Process

Every submitted book is reviewed by Playwithtamil moderators to ensure it:

• Meets educational standards.
• Contains appropriate content.
• Does not violate copyright or applicable laws.
• Maintains acceptable language and quality.
• Is suitable for the intended audience.

Playwithtamil may approve the submission, request corrections or revisions, or reject the submission entirely. Only approved books will be published.

Author Responsibilities

By submitting a book, authors confirm that:

• They are the rightful owner of the submitted work.
• They possess all required rights and permissions.
• Their content does not infringe intellectual property rights.
• Their submission is accurate and lawful.
• Their content does not contain harmful, illegal, misleading, defamatory, obscene, or offensive material.

Authors remain solely responsible for all submitted content.

Author Refund Policy

Publishing fees are generally non-refundable once the review process has started. However, Playwithtamil may issue refunds at its sole discretion under exceptional circumstances.

Eligible Refund Situations

• Playwithtamil permanently rejects the submitted book during moderation.
• After contacting Playwithtamil Support, the refund request is reviewed and approved.
• Multiple review attempts fail and the author requests cancellation.
• Technical payment errors resulting in duplicate charges.

Refund approval remains entirely at the discretion of Playwithtamil.

Refund requests may be denied if the author changes their mind, declines requested revisions, the book has already been approved or published, or the review process has been successfully completed.

Author Rewards Program

Playwithtamil may offer an Author Rewards Program to encourage quality educational publishing.

• Rewards may be earned based on publishing activity, reader engagement, or promotional programs.
• Rewards become available only after the required eligibility threshold has been achieved.
• Rewards are credited only after they have been successfully claimed.
• Claimed rewards cannot be cancelled.
• Rewards are non-transferable and cannot be exchanged for cash.
• Coupons, promotional credits, discounts, vouchers, and redeemed rewards are non-refundable.
• Playwithtamil reserves the right to modify or discontinue the rewards program at any time.

Artificial Intelligence (AI) Features

Playwithtamil uses Artificial Intelligence (AI) to enhance educational experiences across the platform, including:

• Course evaluations
• Learning recommendations
• Content improvements
• Writing assistance
• Educational suggestions
• Content moderation
• Author review assistance

Although we continuously improve our AI systems, AI-generated results are not guaranteed to be completely accurate, complete, or error-free. AI outputs should be treated as guidance rather than definitive educational advice. Playwithtamil continuously reviews and improves AI performance through ongoing development and human oversight.

Human Review & Quality Assurance

To maintain educational quality and authenticity, Playwithtamil combines Artificial Intelligence with human moderation and review wherever practical. Most educational content, books, activities, and publishing decisions undergo manual review before becoming available to users. While we strive for the highest level of accuracy, occasional errors may still occur.

AI Course Evaluation Disclaimer

Some courses include AI-assisted evaluations, scoring, pronunciation assessment, writing analysis, or learning feedback. These evaluations are intended to support learning and should not be considered official academic assessments. AI evaluations may occasionally produce inaccurate or inconsistent results. Users are encouraged to use these evaluations as learning guidance rather than as final or authoritative assessments. Playwithtamil continuously improves the accuracy of these evaluation systems through ongoing updates and human review.

DMCA / Copyright Takedown Policy

Playwithtamil respects intellectual property rights. Valid copyright complaints may result in temporary removal during investigation. Confirmed infringements may lead to permanent removal, account suspension or termination. False claims may result in legal action.

Author Account Suspension & Termination

Playwithtamil may warn, suspend, restrict, or permanently terminate author accounts for repeated policy violations, plagiarism, copyright infringement, fraud, abusive behavior, or illegal activities. Removed content and terminated accounts are not automatically eligible for refunds.

Book Update & Version Policy

Authors may update books, but all updates are subject to review and approval before publication. Major revisions may require a full moderation review. Previous versions may be retained internally for auditing, security, or legal compliance.

Community Guidelines

Users and authors must maintain a respectful educational environment and must not upload illegal, abusive, harmful, misleading, copyrighted, or malicious content. Playwithtamil reserves the right to remove violating content and take appropriate enforcement action.

Refund Policy

All sales are final; no refunds available after purchase. Review plans thoroughly before subscribing.

Subscription Offers and Pricing

Any promotional offers provided by playwithtamil at the time of subscribing to a plan remain valid only for the duration of an active subscription. Upon cancellation of your subscription, all promotional offers and associated discounted rates expire. If you choose to resubscribe at a later time, the subscription will be billed at the standard listed price without promotional discounts.

Additionally, if you are invited by a non-profit school and subscribe to either the Titanium Plan (for kids) or Gold Plan (for teachers) upon joining the school, you may receive a special school-based discount determined by the inviting school. This special discount remains valid only while you are affiliated with that school. Upon leaving the school, your subscription pricing will revert to the standard playwithtamil pricing. However, the standard 'Welcome Offer,' applicable to all first-time subscribers, remains available until activated by the user's initial subscription.

Account Deactivation

Users may deactivate their account at any time. Upon initiating account deactivation, a 21-day grace period is provided, allowing users to retrieve any personal data or content stored with us. Within this 21-day period, users have the option to reactivate their account. After the grace period ends, the account and all associated user data are permanently deleted from our database.

If the primary user account is linked to one or more kid accounts (secondary accounts), these secondary accounts will also be permanently deleted and erased from our systems upon expiration of the 21-day period.

Important: Users currently affiliated with or bound to a school cannot deactivate their accounts until they have formally exited or been unbound from the school. To proceed with deactivation, users must first leave the school.

Limitation of Liability

We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Total liability under these terms shall not exceed the amount paid by you for the Service in the past 12 months.

Indemnification (User Responsibility)

Users agree to cover costs, losses, or damages if their actions (such as misuse or breaking these Terms) cause harm to Agaminfotech Inc.

Changes and Amendments

We reserve the right to modify these Terms periodically. Updates will be communicated via our site; users must regularly review these Terms.

Governing Law

These Terms are governed by applicable local and international laws. Disputes will be resolved through mutual negotiation or relevant legal proceedings.
